about to file for a divorce stay tuned I’m Mark Bernstein and today I’ll be discussing what you should be considering before you file for divorce the first thing you should consider is what your expectations are they reasonable what’s your likelihood of success you should sit down with your attorney and determine these you don’t want to put in your complaint and your summons certain issues that are going to extend the litigation cost you more money that you have no likelihood of success for example maintenance or alimony if you both earn about the same amount of money you’re not going to get maintenance why put it in why litigate why alienate your spouse in custody is a huge issue a lot of people put custody in not for a legitimate purpose but more strategic the problem is it usually backfires because it does alienate the other party it does increase the cost so you want to do is you want to have a real heart-to-heart with your lawyer and say do I is it possible I’m going to get custody most of the cases are pretty clear-cut if you’re in a gray area absolutely should try but most of clear cuts so if you’re the money spouse and you work 80 hours a week and the wife stays home and takes care of the kids that she’s a great mom and do mom’s been taking care of the kids for the last 10 15 years the odds are you’re not going to get custody what you should focus on if you’re the non-custodial parent instead focus on visitation you want very liberal visitation you want vacations you want maybe middle of the week visits focus on what’s important to you what you can what you can obtain not what you can obtain this is Mark Bernstein those are a few ways that you can reduce your costs in litigation reduce the animosity reduce the emotion involved so if you have any questions about how to reduce the cost and how to have a reasonable summons and complaint in a reasonable divorce please give me a call.
